Hawaii Court Upholds State's Concealed Carry Law

Another decision among many that affirm reasonable restrictions on carrying guns in public

Washington, D.C. - The Brady Center today made the following announcement:

A federal judge in Hawaii has upheld Hawaii's concealed carry laws as Constitutional, dismissing a lawsuit, in the case, Young v. State of Hawaii, that claimed a Constitutional right to carry loaded guns in public.

“This decision is the latest in a series of similar victories, upholding reasonable restrictions on carrying guns in public in New York, New Jersey, California, and elsewhere,” said Brady Center Legal Action Project Director Jonathan Lowy. “Nobody wants to live in a nation with 32 murders every day and nearly 100 people shot. The Court’s decision makes it clear that we have the potential to do something about the tragedy of gun violence and make this the safer nation we all want and deserve.”

The Brady Center has assisted attorneys from Hawaii and Honolulu in defending their laws in a number of cases, including this one (Young has brought three similar lawsuits). The court held that the weight of authority is that the U.S. Supreme Court's decisions in Heller and McDonald "establishes only a narrow individual right to keep an operable handgun at home for self-defense."
