PROBLEM: If passed, this legislation would undermine federal law enforcement and protect corrupt gun dealers in several ways. The legislation would:
1. Severely hinder ATF’s ability to shut down corrupt gun dealers by requiring ATF to show that the dealer not only violated the law, but had the specific intent to break the law, before revoking the dealer’s license. 2. Prohibit ATF from revoking licenses of gun dealers who commit many dangerous crimes, such as when a dealer allows hundreds of guns to “disappear” from its inventory with no record of sale.
3. Cap fines at extremely low levels for violations found during an inspection of a gun dealer. For example, a dealer with 900 federal gun law violations would face a maximum fine of less than $8.50 per violation.
4. Allow most dealers who violate gun laws to continue selling guns for 60 days after their licenses are revoked, even if they committed willful violations of federal law.
THREAT: This legislation would put communities and families at risk by protecting corrupt gun dealers and allowing them to continue selling guns into the illegal gun market. For example, it would have protected former NRA Board Member Sanford Abrams, whose gun shop near Baltimore, Maryland was shut down after being cited for over 900 federal gun law violations. URGENCY: This legislation dangerously constrains ATF from going after corrupt gun dealers who repeatedly violate federal gun laws. One percent of gun dealers supply nearly 60% of all crime guns recovered in America. ATF must have the tools it needs to enforce the law and shut down corrupt gun dealers.
SOLUTION: For the safety of our communities and families, Congress should reject the ATF “Reform and Firearms Modernization Act”.
